Apple Forced to Remove All 3G iOS Devices Except iPhone 4S From Online Store in Germany

“Apple believes this old pager patent is invalid and we’re appealing the courts decision,” company spokesman Alan Hely said in an e-mailed statement.”
While some iPad and iPhone models are not available through Apple ’s online store in Germany right now, customers should have no problem finding them at one of our retail stores or an authorized reseller. Apple is appealing this ruling because Motorola repeatedly refuses to license this patent to Apple on reasonable terms, despite having declared it an industry standard patent seven years ago.
Apple had tried to use the “FRAND” defense, claiming that the patent was essential to the 3G standard and needed “fair, reasonable, and non-discriminatory” terms for licensing it.
The logic presented by Motorola’s counsel convinced the court: someone using a patented invention should have to pay a price for being found to have infringed. While competition law requires the patent holder to extend a license on FRAND terms going forward, past infringement is a different matter. If, in the alternative, damages for past infringement were limited to a FRAND royalty rate, Motorola and Judge Voß argue, an infringer might ultimately get to use the patent on more favorable terms than someone procuring a license at the outset. They say that favorable terms would result from a scenario in which payments for using the patent in the past can be avoided by proving the patent invalid.
It is not clear why Apple has not removed iPhone 4S from the online store, but it is possible that since iPhone 4S is relatively new, Motorola had not included it while filing the patent lawsuit.

iPhone 4S sales resume online in China, shipments by March 2

The iPhone 4S launch in China did not go quite as Apple had planned.

Throngs of people are a norm for new product launches at Apple , but the gaggle of scalpers trying to hustle the system caused Apple to delay sales, earning its stores an egg wash and plenty of animosity. Now, after implementing a lottery system for ordering the iPhone 4S, Apple has resumed selling the device online and will ship by March 2.

The lottery reservation system seems to be doing its job; scalping is on the decline and the customers who have abided by the buying policies are now able to get their iPhone 4Ses.

Add that to Apple ‘s stockpile of available iPhone 4S units finally catching up to the initial demand and people in China are now looking at reasonable shipping times. Of course in this case, reasonable is about a month. But that is not likely to deter many as the iPhone continues to make a dent in the Chinese smartphone market.

According to a report from China Daily the shipping times for iPhones in China actually vary quite a bit. “If you pay today, you might get the items tomorrow, and no later than March 2,” said a telephone sales operator.

All iPad And iPhone Models Will be Available on Apple’s Online Store in Germany Shortly as Injunction Temporarily Suspended

In a statement given to AllThingsD, Apple confirmed that the iPhone 3G, iPhone 3GS, iPhone 4 and 3G/UMTS-based iPads should be returning to the shelves of its German online store in a matter of hours.
“All iPad and iPhone models will be back on sale through Apple ’s online store in Germany shortly,” an Apple spokeswoman told AllThingsD. “Apple appealed this ruling because Motorola repeatedly refuses to license this patent to Apple on reasonable terms, despite having declared it an industry standard patent seven years ago.”
has clarified that Apple has just received a temporary retrieve from the court until the legal issue raised by Apple has been adjudicated.
A statement by the appeals court clarifies that this temporary suspension will be in effect only for a limited period of time. The Mannheim ruling has not been overturned: this is just some temporary reprieve. In a best-case scenario for Apple , the suspension would have been in effect until the appeals court makes a decision on Apple ‘s appeal. In that case, it would have been in effect for well over a year — and that could still happen, but it need not.
Apple had tried to use the “FRAND” defense, claiming that the patent was essential to the 3G standard and needed “fair, reasonable, and non-discriminatory” terms for licensing it, but had failed to convince the judge last time round as their offer to Motorola to use their patent was deemed insufficient by the regional court back in December. FOSS Patent reports that Apple has made a new offer to Motorola, but it remains to be seen if it successful when their appeal comes up for hearing.

iPhone, iPad ring in 13 percent of all online purchases on Christmas

If you used an iPhone or iPad to buy something online on Christmas, you had plenty of company.

Among all online purchases made on Christmas Day, 7 percent were done through an iPad and 6.4 percent through an iPhone , giving iOS devices 13.4 percent of all online purchases that day.

Eyeing online sales across 500 retailers on December 25 and 26, IBM’s latest holiday benchmark report found a surge in cybershopping from mobile devices.

Android devices accounted for 5 percent of all online purchases on Christmas Day. And moving to the next day, the iPad again led with 6 percent of all online purchases, followed by the iPhone with 5.8 percent and Android with 4.6 percent.

Overall, online sales on Christmas Day grew by 16.4 compared with last year. Among all the online traffic analyzed by IBM, 18.3 came from a mobile device, a jump of 118 percent from Christmas of 2010. And actual online purchases from mobile devices hit 14.4 percent, a leap of 173 percent from last Christmas.

New Apple Store App And In-Store Pick Up Option For Online Orders May Be Launched On Nov 3rd

In the last few days, we’ve heard rumors that Apple is about to rollout some changes to Apple Retail stores, which includes an option for customers to pick-up online orders at Apple retail stores and also a

after you find the item you want to buy, like an accessory, you launch the Apple Store app on your iOS device and there will be an option to buy a product in the store. You scan the product with the camera on your device in the app, click purchase, and it will charge whatever credit card is associated to your Apple ID. You then just walk out of the store. Yes, we have been told that Apple will not be checking purchases which seems hard to believe, but this self check-out option will launch Thursday worldwide at all Apple retail stores.
If a customer places an order for an in-stock product, then the product will be available for pickup in about 12 minutes. That’s apparently enough time for the Apple Store to receive the order and for retail store employees to set the product aside that was ordered.
If a customer places an order for a product that a retail store does not have in stock, then the customer will receive a delivery date after the purchase is completed. Once the order arrives at the Apple Store and is available for pickup (the 12 minutes time frame as mentioned above will apply in this case as well), the customer will get a push notification through the Apple Store app, to inform him or her that the order is ready for pickup.
Everything that is picked up from Apple Retail store comes with free shipping.
Apple will offer customers the option to return items purchased online to retail stores.
It will be only available in the U.S. for now.
Apple hopes that most of the customers will pick-up their online orders from Apple retail stores.
Apple is expected to launch the self-checkout option and in-store pickup option of online orders on Thursday, November 3rd. These are quite significant changes that should improve the experience while purchasing Apple products.

iPhone 4 launch: not a picnic.

With any new Apple iPhone or iPad, a logistical question emerges that bears considering: how do you buy it without enduring a line or a long wait time? The iPhone 4S goes on sale next week on October 14, and it’s crossed my mind that my travails with both the iPhone 4 and iPad 2 weren’t pretty. Resellers have recently been largely responsible for making the already challenging Apple Store lines an unbearable ordeal with products being sold out well before most people even knew they were back in stock.

In fact, I preordered an iPad 2 back in the spring, then canceled when I decided that the two-week wait time could be bettered by a quick trip to the Apple Store. I bet wrong, and spent two weeks calling Best Buys and searching message boards for a place that would have the iPad I wanted in stock.

Embarrassing, yes, but this was a common occurrence for many people during the first month or so of both the iPhone 4 and iPad 2′s existence.
