Apple Sues Nokia Again – Seeks Ban On Import Of Nokia Phones

Apple has now responded. In a counter-suit filed with the ITC, Apple claims patent violations by the Finland based company and has sought ITC's help in banning the import of their patent-infringing devices to the US market.
This is the second time in as many months when Apple has filed a lawsuit against Nokia. In December last year,
for having infringed upon 13 of their proprietary innovations. In both these instances, the lawsuits have served as a retort to Nokia's court filings against Cupertino. Nokia's lawsuits against Apple are largely seen as a way for Espoo to regain its holding in the market which it once dominated. The market share of Nokia has slipped from 42.3% in 2008 to 39.3% by the end of 2009 and with increasing competition from companies like Apple , RIM and Palm, Nokia has its task cut out in the next few months to retain its leadership in the market.
Responding to Apple 's patent, Nokia spokesman Mark Durrant said:
“Nokia will study the complaint when it is received and continue to defend itself vigorously. However this does not alter the fact that Apple has failed to agree appropriate terms for using Nokia technology and has been seeking a free ride on Nokia‚Äôs innovation since it shipped the first iPhone in 2007.”
